Defense Victory: Summary Judgement Granted in Workplace Injury Case
Martin Moreno secured a summary judgment victory on behalf of his client, a general contractor, in a personal injury lawsuit involving a workplace accident.
The plaintiff, an employee of a subcontractor, alleged serious injuries arising from the use of jobsite equipment. Our firm moved for summary judgment under the Privette doctrine, arguing that our client, as the hiring party, neither retained control over the manner in which the subcontractor performed its work nor affirmatively contributed to the alleged harm.
The Court granted our motion in full, finding no triable issues of material fact under the controlling California Supreme Court precedents, including Privette, Hooker, and Sandoval. This result reinforces the strong protections available to hiring parties who properly delegate workplace responsibilities to independent contractors. This outcome reflects our firm’s deep expertise in defending general contractors, developers, and business owners in high-stakes premises and workplace litigation.

WMMG Secures full Dismissal in Complex Medical Privacy Case
WMMG recently secured a full dismissal for a multiple corporate clients in advance of a demurrer with the plaintiff receiving nothing. The lawsuit, filed in Santa Clara County Superior Court, alleged a series of highly-technical claims concerning the California Confidentiality of Medical Information Act, California Insurance Code, related violations of other California laws. WMMG’s clients were accused of having mishandled medical information in conjunction with an ongoing disputes over contested personal injury claims. Shareholder Tristan Mullis crafted a detailed demurrer that attacked each cause of action sufficient to cause the plaintiff to dismiss his claims in their entirety before the hearing, without any compensation. This early outcome minimized defense expenses for the client, while securing a full win on the case

Major Arbitration Victory for WMMG Defense Team
